Accused meted life imprisonment for violation of RA 9165

The Department of Justice-National Prosecution Service (NPS) scored another victory against Tanniex Bangkong y Tingalon for violation of Section 5 Article II, of R.A. 9165, otherwise known as "The   Comprehensive Dangerous Drugs Act of 2002.”

"The RTC-Muntinlupa City Branch 204, in its January 29, 2014 Decision, found the accused guilty beyond reasonable doubt of the crime, and meted him life imprisonment and to pay a fine of Php500,000.00.

Court records show that Tanniex Bangkong has set the place and time of meeting with a team of police officers with SP02 Albert Palencia who acted as a team leader in front of Jollibee on the 4th floor of Alabang Festival Mall. The team accompanied by informant reached the meeting place ahead of the agreed time deliberately to post members of the team strategically and incognito. At two o'clock in the afternoon, a man who just fits the description of the suspect arrived and thereby approached agent Gillego and informant. With the suspect asking for the money follows handing to poser buyer a small "ink for less" plastic bag containing white crystalline substance ["shabu"], prompting the authorities to make the arrest and secure the area.

Presented by the Prosecution as strong evidence was the buy-bust operation which was conducted on August 25, 2008 by police officers with SP02 Albert Palencia who acted as team leader. Prosecution witnesses Agents 101 Marie Joy D. Gillego and 101 Romano Alfonso were designated as poser buyer and immediate back-up, respectively.

The operation confirms the illegal drug pushing activities of then suspect, Bangkong y Tingalon alias @ Oteng, who hails from Bayanan, Muntinlupa City.

"With the pieces of evidences presented, the trial court was convinced that the corpus delicti or the drug evidence in this case has been sufficiently safeguarded when presented and identified in court  by 101 Gillego as the same drug evidence sold and confiscated from the accused," the court decision reads.

Handling the criminal case which has been forwarded to the Appellate Court last February 7, 2014 is Assistant State Prosecutor Romeo B. Senson.
